Who pays the BUYER'S AGENT fee?
In the vast majority of cases, the entire commission is paid by the seller. However, there is no requirement that they do so. So be sure to clearly understand the terms of your agreement with your Buyer’s agent and how such a situation would be handled.

Keep in mind, however, the cost of not having a BUYER'S AGENT may far outweigh the cost of having one.

What is an ‘in-company’ situation?
In some situations, a home buyer wishes to purchase a home that the BUYER'S AGENT is listing for a seller or is listed by another agent at the Buyer’s agent’s real estate company. In this situation, the Buyer’s agent's ability to represent the buyer and seller may be limited. This may also be known as “Designated Representative,” “Transaction Broker,” “Facilitator,” or “Disclosed Dual Agent.”

If such a situation occurs, it must be disclosed by both agents. From there, written consent to modify the agency relationship is produced. In Alabama, the situation can exist where different sales associates of the same agency can fully represent their clients on both the buying and selling sides.
